A bold move by Hawaii to tackle climate change has sparked controversy and a legal battle. The state's plan to introduce a tourist tax on cruise ships has been temporarily halted by a federal court, leaving many questions and debates in its wake.
The proposed tax, aimed at addressing the impacts of climate change, faced opposition from the Cruise Lines International Association (CLIA). CLIA argued that the tax violates the U.S. Constitution and would increase the cost of cruises, potentially deterring tourists. The lawsuit highlighted the law's authorization for counties to collect an additional 3% surcharge, resulting in a total tax of 14% on prorated fares.
Hawaii's innovative approach to climate funding involved increasing taxes on hotel stays and vacation rentals, as well as introducing a new 11% tax on cruise ship passengers' gross fares, prorated for the number of days spent in Hawaiian ports. This was the nation's first attempt at a levy specifically targeting climate change, with Governor Josh Green signing the legislation in May. The tax was estimated to generate nearly $100 million annually, a significant contribution to addressing issues like eroding shorelines and wildfires.
However, the U.S. District Judge Jill A. Otake's decision to uphold the law was appealed by the plaintiffs, with the U.S. government also intervening and appealing the ruling. The 9th U.S. Circuit Court of Appeals granted an injunction, temporarily halting the tax's enforcement on cruise ships while the appeals process continues.
Toni Schwartz, spokesperson for the Hawaii attorney general's office, expressed confidence in the law's legality, stating, "We remain confident that Act 96 is lawful and will be vindicated when the appeal is heard on the merits."
